  • 本人余2019年购入一套商品房,约定2020年6月30号前正式交房,但是开发商一直拖到2022年3月份都未正式交房!之前起诉开发商逾期交房赔付违约金,但是港北区以没有正式交房为由请求撤回起诉!请问如果开发商一直不交房,我们是不是一直起诉不了开发商赔付违约金!

         关于您咨询的问题,现回复如下:根据《中华人民共和国民事诉讼法》第一百二十二条第三项规定,民事起诉必须有具体的诉讼请求和事实、理由。据您所述,如果商品房尚未符合合同约定交付条件,开发商未通知您收房,因商品房何时能交付无法确定,您主张开发商赔付逾期交房违约金,起诉请求不具体明确,不符合法律规定的民事起诉条件,法院会裁定不予受理。
